Road Opening Permits
Road Opening Permits must be obtained by any person or contractor working on the Town’s right-of-way. The right-of-way includes the roadway, curb strip and sidewalk. Requirements for road opening permits include application(s), certain insurance(s) and fee(s); and in the case of curb cuts, plans must also be submitted. The permit must be in possession of the parties actually doing the work.
For a curb cut permit, the applicant must first submit three (3) copies of a set of plans showing exactly where you want the curb cut to be located, including the footage to the nearest intersection, and the exact size of the curb cut. The Foreman will make an on-site inspection to approve the location and size.

The Town cannot recommend a particular contractor. Plans for curb cuts may be submitted for inspection prior to hiring a contractor.
Specifically, dumpster permits are valid for thirty (30) days. A dumpster permit may be renewed for a second thirty (30) day period, and then the dumpster must be removed.
Curb cuts must remain at least 2' from each side property line. Curb Cuts must remain at least 3' from the nearest utility pole. Curb cuts must remain at least 5' from the beginning of the curb radius at an intersection. Curb cuts must remain at least 2' from existing trees, light poles or 5' from fire hydrants.
Circular driveways require a minimum property frontage measurement of 50'. One single curb cut and one double curb cut is allowable, also two single curb cuts are allowable, but two double curb cuts are not allowable. An 18' span must remain between the two curb cuts.
Insurance requirements are as follows:
1. A certificate of general liability naming the Town of North Hempstead as an additional insured.
Bodily Injury & Property Damage - $1,000,000. combined single limit
2. A certificate of Worker’s Compensation
3. A certificate of New York State Disability
4. Either a $10,000. Performance Bond naming the Town as obligee, or a $2,000. certified check which will be held for a minimum of 90 days after completion of work.
Permit fees are as follows:
1. Residential – curb cuts, curbing - $250.00
2. Residential – sidewalk - $200.00
3. Commercial – curb cuts, curbing - $400.00
4. Commercial – sidewalk - $350.00
5. 4' x 4' openings (gas, water, sewer, electric) - $350.00
cost per square foot more 4' x4' - $50
6. Environmental test holes (blanket) - $50.00
7. Dumpsters - $300.00
8. Deposit for repairs & replacement (4' x 4' minimum) - $500.00
9. Restoration charge per square foot - $50.00
10. Tree Removal & Replacement - $150.00
11. Trenching - first 25' - $150.00
Trenching - each 100' thereafter - $200.00
