Town Park Proposed Ordinance of the Town of North Hempstead
This ordinance shall amend Town Park Ordinance No. 2 of 2019 to prohibit the presence of dogs in parks during events in which fireworks are scheduled to be used.

This ordinance will establish rules to regulate the dog park established in Michael J. Tully Park and require the Commissioner to report to the Town Board on an annual basis concerning the effectiveness of the program allowing the presence of unleashed dogs in the dog park.

The purpose of the local law is to amend Local Law No. 11 of 2019, adopted June 18, 2019, to extend the building moratorium in the Waterfront Business District (B-W) through April 1, 2020.

The purpose of the local law is to amend the regulations governing the Waterfront Business District to protect the nature of the Port Washington waterfront, afford residents of the Town the ability to use and enjoy the waterfront, while allowing reasonable and sustainable development within the District.

A Local Law Amending Chapter 14 of the Town Code Entitled “Dogs”  
The purpose of the local law is to establish new regulations and amend existing regulations addressing the outside tethering of dogs and adjust the penalties for certain offenses.

A Local Law Amending Chapter 38A of the Town Code Entitled “Landscaping and Gardening” 
The purpose of the local law is to amend Chapter 38A of the Town Code entitled “Landscaping and Gardening” in order to clarify that the seasonal restriction on the use of gas-powered leaf blowers applies to all landscapers performing commercial landscape gardening activities within the Town as well as to Town employees performing landscaping on Town-owned property.

The purpose of the local law is to amend Chapter 2 of the Town Code entitled “Administration and Enforcement” to correct a reference error in Section 2-35(U) of the Town Code concerning the suspension or revocation of plumbing licenses and certificates of competency and make further reference changes in Section 2-72 of the Town Code with regard to the suspension or revocation of electrical licenses and certificates of competency.

The purpose of the local law is to amend Chapter 28 of the Town Code entitled “Housing, Rehabilitation and Property Maintenance Code” to require that materials used to cover over graffiti be of the same or similar color as the surface upon which the graffiti was made.

A Local Law Amending Article Ix Of The Uniform Traffic Code Of The Town Of North Hempstead Entitled “Port Washington Public Parking District”

The purpose of the local law is to allow first responders and emergency medical personnel to park for up to seventy-two (72) hours in spaces regulated by the Port Washington Public Parking District.

The purpose of the local law is to amend Local Law No. 11 of 2017, adopted December 19, 2017, establishing a building moratorium in the Waterfront Business District (B-W), in order to extend the moratorium through November 1, 2018.

A Local Law Amending Chapter 2 of the Town Code Entitled "Administration and Enforcement"

The purpose of the local law is to (1) establish a procedure for the revocation and suspension of plumbing and electrical licenses, (2) state that certain fees described in Chapter 2 will be found in the Town of North Hempstead Fee Schedule, and (3) make certain technical corrections to the procedures for issuing plumbing permits.

The purpose of the local law is to allow auctions of abandoned personal property to occur via the internet and to clarify the notice provisions to be complied with prior to an auction.

The purpose of the Local Law is to amend Chapter 70 of the Town Code to update and strengthen the requirements for parking and food garbage treatment for restaurants and to simplify the requirements for making changes to restaurant facilities.

A Local Law Amending Chapter 75 of the Town Code Entitled "Wireless Telecommunications Facilities"  
The Board finds that it is in the best interest of the Town of North Hempstead to amend Chapter 75 of the Town Code entitled “Wireless Telecommunications Facilities” to state that the fee for renewal of antenna location permits is found in the Town of North Hempstead Fee Schedule.

A Local Law Imposing a Building Moratorium in the Waterfront Business District (B-W)  

The Town Board of The Town of North Hempstead finds that it is in the best interest of the Town to impose a one hundred and eighty (180) day moratorium on the development of certain real property in the hamlet of Port Washington identified in Section 2 hereof, requiring the issuance of building permits, demolition permits, special permits, or any other discretionary approval.

A Local Law Amending Chapter 51 of the Town Code Entitled “Taxation”  
The purpose of the local law is to amend Chapter 51 of the Town Code to amend the effectiveness of the partial real property tax exemption for qualified Cold War veterans so that it extends for as long as a qualified owner of the property, as defined by Chapter 51, remains a qualified owner.

The Board finds that it is in the best interest of the Town of North Hempstead to amend Chapter 38 of the Town Code entitled “Noise” to restrict the use of gasoline-powered leaf blowers.

A Local Law Amending Chapter 24 Of The Town Code Entitled "Governmental Operations"
The Board finds that it is in the best interest of the Town of North Hempstead to amend Chapter 24 of the Town Code entitled “Governmental Operations” to codify the Town's requirement that, with respect to certain Town construction contracts, contractors and subcontractors shall have in place apprenticeship training agreements appropriate for the type and scope of work to be performed and must demonstrate that the apprenticeship programs used on these projects have graduated apprentices. The proposed local law also states that the local law would only apply to construction contracts in excess of $500.000.

The Board finds that it is in the best interest of the Town of North Hempstead to amend Chapter 2 of the Town Code entitled “Administration and Enforcement” in order to require applicants for building permits for large commercial projects to demonstrate that apprenticeship programs used by contractors or subcontractors on these projects have graduated apprentices.

The Board finds that it is in the best interest of the Town of North Hempstead to make amendments to Chapter 23 of the Town Code entitled "Governmental Departments" in order to modify the organization structure of the Department of Building and Safety Inspection and Enforcement by authorizing the Commissioner to appoint a second exempt deputy, who may act generally for the Commissioner in the absence of the Commissioner.

The Board finds that it is in the best interest of the Town of North Hempstead to establish Chapter 65A of the Town Code entitled "All-Terrain Vehicles" in order to establish restrictions of the use of all-terrain vehicles on Town property.

A Local Law Amending Chapter 24 of the Town Code Entitled "Governmental Operations"

The Board finds that it is in the best interest of the Town of North Hempstead to make amendments to Chapter 24 of the code of the Town of North Hempstead entitled "Governmental Operations" by establishing Article IX entitled "Contract Restrictions" in order to prohibit the Town from contracting with companies that participate in the movement to boycott, divest from investing in and sanction Isreal.

The Board finds that it is in the best interest of the Town ofNorth Hempstead to amend Chapter 28 of the Town Code entitled "Housing, Rehabilitation and Property Maintenance Code" in order to make a technical change to the "penalties for offenses" section.

The purpose of the amendment is to amend various provisions of the Town's Code of Ethics including, amongst other things, conflicts of interest, interests in contracts, gifts, disclosure, recusal, use of Town resources, private employment and the composition of the Board of Ethics.

The purpose of the local law is to establish regulations addressing the employment, supervision, transfer or recommendation of relatives of Town officers or employees.

The purpose of the local law is to amend Section 52-26(A)(2) of the Town Code to expand the definition of "Town taxi transportation services" to include Town Programs other than the Town's Project Independence taxi transportation program.

A Local Law Establishing Chapter 23 of the Town Code Entitled "Governmental Departments"
In order to promote the efficient discharge of Town functions, the Board finds that it is in the best interest of the Town of North Hempstead that Chapter 23 of the Town Code be amended in order to include the Division of Highways as a division in the Department of Public Works.

A Local Law Establishing Chapter 54 of the Town Code Entitled "Sale of Tobacco Products, Liquid Nicotine and Electronic Cigarettes to Persons Under 21 Prohibited."

The Board finds that it is in the best interest of the Town of North Hempstead to establish Chapter 54 of the Town Code entitled "Sale of Tobacco Products, Liquid Nicotine and Electronic Cigarettes to Persons under 21 Prohibited" in order to prohibit any person operating a place of business wherein tobacco products, liquid nicotine and electronic cigarettes are sold or offered for sale from selling such products to individuals under 21 years of age.

A Local Law Amending Chapter 70 of the Town Code Entitled "Zoning"

The Board finds that it is in the best interest of the Town of North Hempstead to make amendments to Chapter 70 entitled "Zoning" in order to establish restrictions related to the advertising of electronic cigarettes, liquid nicotine and hookah tobacco in any outdoor area within 500 feet of any park or school, or within the interior of any building or structure which is within 500 feet of any park or school, when such advertisement is within five feet of any exterior window or any door which is used for entry or egress to the building or structure by the public; except that such advertisements may be placed or maintained in the interior of any such premises where they are parallel to said windows or entryways and face inward or are affixed to a wall panel or similar fixture that is perpendicular to said windows or entryways.

A Local Law Amending Chapter 23 of the Town Code Entitled "Governmental Departments"  
The Board fmds that it is in the best interest of the Town of North Hempstead to make amendments to Chapter 23 of the Town Code entitled "Govemmental Departments" in order to establish the Division of Security as a division in the Department of Parks and Recreation, and to authorize such division to provide security and protection to Town facilities.

A Local Law Amending Chapter 70 of the Town Code Entitled "Zoning"

The Board finds that it is in the best interest of the Town of North Hempstead to make amendments to Chapter 10 of the Code of the Town of North Hempstead entitled "Buildings, Numbering of' in order to establish criteria for designating honorary street names.

The Board finds that it is in the best interest of the Town of North Hempstead to make amendments to Chapter 70 entitled "Zoning" in order to regulate indoor smoking establishments as a conditional use in the Business and Industrial zoning districts.

A Local Law Amending the Uniform Traffic Code of the Town of North Hempstead
The Board finds that it is in the best interest of the residents of the Town of North Hempstead to amend the Uniform Traffic Code by modifying Article IX entitled “Port Washington Public Parking District” in order to amend the fee charged in shopper parking lots and to authorize parking district personnel to modify parking space designations without Board of Commissioner approval.

The Board finds that it is in the best interest of the Town of North Hempstead to make amendments to Chapter 70 of the Town Code entitled “Zoning” in order to set new size limits and restrictions concerning food preparation for convenience stores located within gasoline service stations.

The Board finds that it is in the best interest of the Town of North Hempstead to Amend Chapter 2 of the Town Code entitled “Administration and Enforcement” in order to require applicants for building permits for large commercial projects to have in place apprenticeship training agreements appropriate for the type and scope of work to be performed which have been registered with and approved by the New York State Commissioner of Labor in accordance with Article 23 of the New York Labor Law.

A Local Law Amending Chapter 70 of the Town Code Entitled "Zoning"
The Board finds that it is in the best interest of the Town of North Hempstead to make amendments to Chapter 70 of the Town Code entitled “Zoning” in order to maintain the character of residential neighborhoods by restricting garage and yard sales to not more than four occurrences of up to three days each per calendar year at one address.

A Local Law Amending Chapter 62 of the Town Code Entitled "Unattended Animals"
The Town Board of the Town of North Hempstead finds that leaving pets inside overheated vehicles on hot days can result in suffering and even death of an animal. The Board thus finds that it is in the best interests of the Town to increase awareness of these dangers by establishing regulations making it a violation for pet owners to leave dogs and other animals unattended in their vehicles for a prolonged period of time without sufficient ventilation or water.

A Local Law Amending Article 36 of The Town Code of The Town of North Hempstead Entitled “Movies And Filming”

The Board finds that it is in the best interests of the Town to make certain amendments to the Town’s regulations governing the application for and granting of permits for filming within the Town to consolidate the permitting process for all filming, whether on Town-owned or non-Town owned properties, into the Office of the Town Clerk, to amend provisions related to fees and notice of those in proximity to filming and to make other amendments to the Town's permitting processes and regulations.   This version of the amendments is meant to supersede the amendments distributed on May 22, 2015.

The Board finds that it is in the best interest of the Town of North Hempstead to make amendments to Chapter 23 entitled “Governmental Departments” in order to prohibit discrimination, harassment or retaliation based on gender identity. 

A Local Law Amending Article 36 of The Town Code of The Town of North Hempstead Entitled “Movies And Filming”  The Board finds that it is in the best interests of the Town to make certain amendments to the Town’s regulations governing the application for and granting of permits for filming within the Town to consolidate the permitting process for all filming, whether on Town-owned or non-Town owned properties, into the Office of the Town Clerk, to amend provisions related to fees and notice of those in proximity to filming and to make other amendments to the Town's permitting processes and regulations. 

A Local Law Amending Chapter 39 of The Town Code Entitled “Regulation of Town Parks, Town Gardens And Town Docks”  The Board finds that it is in the best interest of the Town of North Hempstead to make amendments to Chapter 39 entitled “Regulation of Town Parks, Town Gardens and Town Docks” in order to authorize the Commissioner of the Department of Parks and Recreation to establish rules, subject to Town Board approval, regulating the presence of dogs in Town parks, Town gardens and Town docks. Such rules will establish on a trial basis the presence of dogs in certain areas of North Hempstead Beach Park, Mary Jane Davies Green, and Michael J. Tully Park.
