Proposed Local Laws

Proposed Local Laws must be made public at least ten business days before they are voted on by the North Hempstead Town Board. Below is a list of proposed local laws that will be considered at the next Town Board meeting.  Click on Links below for more information.

A Local Law Amending Chapter 70 of the Town Code entitled “Zoning”
The purpose of the local law is to amend Chapter 70 of the Code of the Town of North Hempstead entitled “Zoning” in order to to permit accessory retail use in the Planned Industrial Park District under certain circumstances, when that use is accessory and incidental to the principal use.

A Local Law amending Article II of the Uniform Traffic Code entitled “Traffic Regulations”
The purpose of the proposed local law is to codify certain statutes under the Vehicle and Traffic Law under the Town Code.

A Local Law amending Chapter 57 of the Town Code entitle “Town Facilities”The purpose of the local law is to create a permitting process for the taking off and landing of Unmanned Aerial Vehicles (“drones”) from Town owned facilities.

A local law amending Chapter 23 of the Town Code entitled “Governmental Departments”
The purpose of the local law is to add the function of “Harbormaster” to the job duties of the Commissioner and Deputy Commissioner of Public Safety of the Town of North Hempstead to provide them with certain privileges of “peace officers” under New York Law.

A Local Law enacting Chapter 76 of the Town Code entitled “Temporary Moratorium on Battery Energy Storage Systems Facilities”
The purpose of the local law is to establish a moratorium on all applications and review of proposals to construct or maintain Battery Energy Storage Systems Facilities in the Town of North Hempstead until the State codifies building and fire prevention regulations for these facilities and until first responders are equipped and trained to respond to potential emergency situations at these facilities.

A Local Law Establishing Chapter 76 of the Town Code entitled “Temporary Moratorium on Battery Energy Storage Systems Facilities”

A Local Law Amending Chapter 70 of the Town Code entitled “Zoning”

A Local Law Amending Chapter 70 of the Town Code entitled “Zoning”
The purpose of the local law is to amend Chapter 70 of the Code of the Town of North Hempstead entitled “Zoning” in order to reduce the impact of subdivisions in established neighborhoods by requiring that new homes meet the greater of the minimum lot width for the residential zone or the average lot width of surrounding homes in a neighborhood.

A Local Law Amending Chapter 51 of the Town Code Entitled "Taxation"
The purpose of the local law is to amend Chapter 51 of the Town Code to add a new Article IX entitled Duplicate Tax Bills that will establish a $10 fee for banks, lending institutions, financial institutions, title insurance companies or abstract companies or their agents when they request a physical duplicate tax bill or when they fail to include the original bill with their payment to the Tax Receiver's Office. The fee will defray the cost of producing duplicate property tax bills that are required to process the property tax payments made by certain third-party payors of property taxes.


A Local Law Amending Chapter 70 of the Town Code Entitled “Zoning”
The purpose of the local law is to make amendments to Chapter 70 of the Town Code to further assist those establishments affected by the COVID-19 pandemic by extending the timeframe to continue allowing temporary outdoor seating and other temporary outdoor uses until December 31, 2024.

A Local Law Amending Article IX of the Uniform Traffic Code Entitled “Port Washington Public Parking District”
The purpose of the local law is to amend Article IX of the Uniform Traffic Code entitled “Port Washington Public Parking District” in order to authorize electric vehicle parking and charging in Lot 4 and to provide for related parking enforcement.

A local law amending Chapter 24 of the Town Code entitled “Governmental Operations.”
The purpose of the local law is to amend Chapter 24 of the Town Code entitled “Governmental Operations” in order to prohibit an elected official, any employee of his or hers, or any person appointed to or employed by any public office or agency from the use or authorization of the use of any facilities of a public office or agency, directly or indirectly, for the purpose of assisting a campaign for election of any person to any office or for the promotion of or opposition to any ballot proposition.

A Local Law Amending Chapter 23 of the Town Code Entitled “Governmental Departments”
The purpose of this local law is to amend Chapter 23 of the Town Code entitled “Governmental Departments” in order to amend the grievance procedure in Chapter 23, Article XVII (Anti-Discrimination Provisions) to designate alternative decision makers in the event certain Town officers or officials, including the Town Supervisor or Deputy Supervisor, are named or involved in a complaint related to allegations of wrongdoing, unlawful discrimination, harassment or retaliation, or otherwise have a conflict; to ensure that the hearing officer who conducts a formal hearing on an Article XVII complaint be unbiased and free from conflicts; and to make such additional amendments to the grievance procedure as the Town Board deems necessary.

A Local Law Amending Chapter 24 of the Town Code Entitled “Governmental Operations”
The purpose of this local law is to amend Chapter 24 of the Town Code entitled “Governmental Operations” in order to require that fiscal impact statements for certain actions by the Town Board be provided in advance of decision making. This proposed Local Law has been amended and supersedes a draft Local Law distributed on July 28, 2023.

A Local Law Amending Chapter 24 of the Town Code Entitled “Governmental Operations”
The purpose of the local law is to amend Chapter 24 of the Code of the Town of North Hempstead entitled “Governmental Operations” in order to add a new article, Article XV, to require that the fiscal impacts of a resolution or action taken by the Town Board be known in advance of decision making.

A local law establishing Chapter 58 of the Town Code entitled “Governmental Transparency.”
The purpose of the local law is to establish Chapter 58 of the Town Code entitled “Governmental Transparency” in order to require the publication of certain documents and/or information on the Town’s website, in a manner that is searchable, in order to increase governmental openness and transparency by facilitating public access to Town records, documents and information that is legally available, with a goal towards engendering greater awareness, input and public participation in the conduct of the affairs of Town government.

A local law amending Chapter 24 of the Town Code entitled “Governmental Operations”
The purpose of the local law is to require that fiscal impact statements for certain actions by the Town Board be provided in advance of decision making.

The purpose of this local law is to require the posting of a list of Landscaping Companies licensed by the Town of North Hempstead on the Town’s website.

A Local Law Amending Chapter 18 of the Town Code Entitled “Highway Excavations and Curb Cuts”
The purpose of the local law is to make amendments to Chapter 18 of the Town Code to modify the procedures for opening recently-paved roadways under certain circumstances.

A local law amending Chapter 4 of the Town Code entitled “Appearance Tickets; Authority to Prosecute.
The purpose of the local law is to allow the Port Washington Garbage District to issue code violation tickets under the Town Code within the district.

A local law establishing Chapter 99 of the Town Code entitled “Miscellaneous Laws.”
The purpose of the local law is to establish Chapter 99 of the Town Code entitled "Miscellaneous Laws" and place in Chapter 99 an extension of the partial exemption from real property taxes for enrolled members of an incorporated volunteer fire company, fire department or incorporated volunteer ambulance service, to unremarried spouses of deceased volunteer fire members and ambulance workers pursuant to Real Property Tax Law Section 466-A.

A Local Law in Relation to the Tax Exemption for Volunteer Firefighters and Volunteer Ambulance Workers
The purpose of the local law is to establish Chapter 99 of the Town Code entitled "Miscellaneous Laws" and place in Chapter 99 an extension of the partial exemption from real property taxes for enrolled members of an incorporated volunteer fire company, fire department or incorporated volunteer ambulance service, to unremarried spouses of deceased volunteer fire members and ambulance workers pursuant to Real Property Tax Law Section 466-A.

A Local Law Amending Article X of the Town of North Hempstead Uniform Traffic Law entitled “Parking Area at Mary Jane Davies Green Park.”
The purpose of the local law is to convert two parking spaces designated as identification sticker parking only to non-identification sticker parking to allow for electric vehicle parking and charging.

A Local Law Establishing Chapter 43 of the Town Code Entitled “Regulation of Public Spaces”
The purpose of the local law is to establish Chapter 43 of the Town Code entitled “Regulation of Public Spaces” as well as adopting regulations prohibiting urinating and defecating in public places and providing penalties for violations.

A Local Law Establishing Chapter 9A of the Town Code Entitled “Building and Safety: Operating Permits”
The purpose of the local law is to establish Chapter 9A of the Town Code to establish minimum standards for the administration and enforcement of the New York State Uniform Fire Prevention and Building Code and the New York State Energy Conservation Construction Code by requiring that operating permits be obtained for the conduct of certain activities or the operation of certain facilities within the Town.

A Local Law Amending Chapter 2 of the Town Code Entitled “Administration and Enforcement”
The purpose of the local law is to make amendments to Chapter 2 of the Town Code to revise certain code enforcement provisions in the Town Code to comply with recent amendments to State regulations regarding the New York State Uniform Building Code and Energy Code.

The purpose of the local law is to make amendments to Chapter 2 of the Town Code to revise certain code enforcement provisions in the Town Code to comply with recent amendments to State regulations regarding the New York State Uniform Building Code and Energy Code.

The purpose of the local law is to make amendments to Chapter 7 of the Town Code to correct the Part of the New York Code, Rules and Regulations containing the Uniform Code: Minimum Standards for Administration and Enforcement.

The purpose of the local law is to make amendments to Chapter 70 of the Town Code to require electric vehicle charging station capabilities in certain residential and commercial contexts.

A Local Law Amending Chapter 48 of the Town Code Entitled “Sidewalks”
The purpose of the local law is to make amendments to Chapter 48 of the Town Code to extend the suspension of the Town Code provisions limiting the number of sidewalk sale permits that may be issued for any given location during a 12 month period and temporarily waive the fees for a sidewalk sale permit through December 31, 2023.

The purpose of the local law is to make amendments to Chapter 2 of the Town Code to promote and encourage the use of solar panels and electric vehicles by creating an expedited permitting process for solar panel installation and electric vehicle charging stations.

A Local Law Amending Chapter 2 of the Town Code Entitled “Administration and Enforcement”
The purpose of the local law is to make amendments to Chapter 2 of the Town Code to extend the suspension of section 2-9 N (7) of the Town Code with respect to tent permits through December 31, 2023.

A Local Law Amending Chapter 75 of the Town Code entitled “Wireless Telecommunications Facilities”.
The purpose of the local law is to amend Chapter 75 of the Code of the Town of North Hempstead entitled “Wireless Telecommunications Facilities” in order to create an administrative process for the issuance of temporary antenna location permits by the Building Department for temporary support structures and the temporary relocation of existing wireless telecommunications equipment to those structures to facilitate the repair and/or renovation of the existing permanent tower or base station.

Nov 4, 2022 
A Local Law Amending Article IX of the Town of North Hempstead Uniform Traffic Code Entitled “Port Washington Public Parking District”.
The purpose of this local law is to allow overnight parking for residents under certain conditions in Lot 7 of the District and to remove Section 83(D)(3) relating to the temporary conversion of commuter parking spaces to metered shopper parking spaces with the intention of converting such spaces by resolution of the Town Board.

The purpose of the local law is to amend Chapter 2 of the Code of the Town of North Hempstead entitled “administration and Enforcement” in order to in order to amend Section 2-35(J)(1) of the Town Code concerning reciprocal plumbing licenses to expand the permitted place of business requirement to include Suffolk County.

The purpose of the local law is to amend Chapter 24 of the Code of the Town of North Hempstead entitled “Governmental Operations” in order to authorize the Town Board, the Board of Zoning and Appeals, the Historic Landmarks Preservation Commission, and all committees or subcommittees of the Town of North Hempstead, to participate in meetings via videoconference in a manner consistent with the Town Board Rules of Procedure and the authority granted in New York Public Officers Law § 103-a.

The purpose of this proposed action is to amend “Parks Ordinance No. 2 of 2019” in order to provide the Commissioner with rule making authority to allow the presence of dogs in Whitney Pond Park.

A Local Law Amending Chapter 2 of the Town Code Entitled “Administration and Enforcement”
The purpose of this local law is to amend Chapter 2 of the Town Code entitled “Administration and Enforcement” in order to make modifications to the procedure on requests for expedited permit application review under Section 2-10.1 of the Town Code.

A Local Law Amending Chapter 2 of the Town Code Entitled “Administration and Enforcement”
The purpose of this local law is to amend Chapter 2 of the Town Code entitled “Administration and Enforcement” in order to remove the requirement that the Supervisor and the Councilperson in the District of an application for an expedited permit under Section 2-10.1 of the Town Code review the application, require the Commissioner of the Department of Building Safety, Inspection and Enforcement to issue a final written determination within seven (7) days of a request for expedited permit application review and to disallow requests for expedited review which do not meet the requirements of Section 2-10.1.

A Local Law Amending Chapter 24 of the Town Code Entitled “Governmental Operations"
The purpose of this local law is to amend Chapter 24 of the Town Code entitled “Governmental Operations” in order to amend Article III related to the submission of annual reports by Commissioners and Department Heads to require monthly reports from the Building Department.

A Local Law Establishing Chapter 65B of the Town Code Entitled “Failure to Stop for School Buses"
The purpose of this local law is to establish Chapter 65B of the Town Code entitled “Failure to Stop for School Buses” in order to establish regulations in accordance with Section 1174-a of the New York State Vehicle and Traffic Law governing drivers who meet or overtake a school bus that has stopped to receive or discharge passengers.

A Local Law Amending Chapter 16A of the Town Code Entitled “Ethics, Code of”
The purpose of the local law is to make amendments to Chapter 16A of the Town Code to require employees appointed to positions enumerated in Section 16A-7 to complete and file a financial disclosure statement within thirty (30) days of their appointment, to require individuals who are nominated for appointment to all permanent Boards and Commissions to complete and file a financial disclosure statement thirty (30) days prior to the Town Board considering the appointment and to clarify the established terms of office of the seven member Board of Ethics.

A Local Law Amending Chapter 39 of the Town Code Entitled “Regulation of Town Parks, Town Gardens and Town Docks”
The purpose of the local law is to make amendments to Chapter 39 of the Town Code to specify that the Commissioner of the Department of Parks and Recreation is authorized to designate bicycle paths in Town parks and docks

A Local Law Amending Chapter 2 of the Town Code Entitled “Administration and Enforcement”
The purpose of the local law is to make amendments to Chapter 2 of the Town Code to remove the requirement that the Supervisor and the Councilperson in the District of an application for an expedited permit under Section 2-10.1 of the Town Code review the application.

A Local Law Amending Chapter 16A of the Town Code Entitled “Ethics, Code of”
The purpose of the local law is to make amendments to Chapter 16A of the Town Code to require individuals who are nominated for appointment to all permanent Boards and Commissions to complete and file a financial disclosure statement prior to the Town Board considering the appointment.

The purpose of the local law is to amend Article IX of the Uniform Traffic Code entitled “Port Washington Public Parking District” in order to continue the temporary conversion of certain commuter parking spaces to metered shopper parking spaces from April 1, 2022 through December 31, 2022.

A Local Law Amending Chapter 27 of the Town Code entitled “Historic Landmarks Preservation”  
The purpose of the local law is to amend Chapter 27 of the Code of the Town of North Hempstead entitled “Historic Landmarks Preservation” in order to modify procedural requirements, eliminate duplicative and conflicting provisions, update certain outdated provisions and to include a mechanism for the expedited review of certain common but minor exterior alterations, restorations and changes of material that do not have a substantial adverse impact on the historic character of a designated Historic Landmark or designated Historic Landmark District.

A Local Law Amending Chapter 15A of the Town Code Entitled “Election Districts”  
The proposed of the local law is to extend the time period to make appropriate revisions of the boundaries of the wards so that they shall contain a substantially equal number of inhabitants from six months to twelve months after the publication of the results of the 2020 federal census.

The purpose of this local law is to amend Chapter 57 of the Code of the Town of North Hempstead entitled “Town Facilities” in order to protect the public from involuntary exposure to tobacco and cannabis smoke and vapor on Town-owned property.

A Local Law Amending Chapter 70 of the Town Code entitled “Zoning”
The purpose of this local law is to amend Chapter 70 of the Town Code entitled “Zoning” in order to incorporate the opt-out provisions of Cannabis Law § 131 relating to recreational retail dispensaries and on-site consumption establishments into the Town’s Zoning Code.

The purpose of the local law is to make amendments to Chapter 70 of the Town Code to amend the standards for residential development in the New Cassel Urban Renewal Overlay District while still requiring compliance with the building and zoning standards applicable to the underlying zone in which the subject property is situated.

The Board finds that it is in the best interest of the Town of North Hempstead to amend Chapter 24 of the Town Code entitled “Governmental Operations” to codify the Town's requirement that, with respect to certain Town construction contracts, contractors and subcontractors shall have in place apprenticeship training agreements appropriate for the type and scope of work to be performed and must demonstrate that the apprenticeship programs used on these projects have graduated apprentices. The proposed local law also states that the local law would only apply to construction contracts in excess of $500.000.

A Local Law Amending Chapter 62 of the Town Code Entitled "Unattended Animals"
The Town Board of the Town of North Hempstead finds that leaving pets inside overheated vehicles on hot days can result in suffering and even death of an animal. The Board thus finds that it is in the best interests of the Town to increase awareness of these dangers by establishing regulations making it a violation for pet owners to leave dogs and other animals unattended in their vehicles for a prolonged period of time without sufficient ventilation or water.

A Local Law Amending Chapter 39 of The Town Code Entitled “Regulation of Town Parks, Town Gardens And Town Docks”  The Board finds that it is in the best interest of the Town of North Hempstead to make amendments to Chapter 39 entitled “Regulation of Town Parks, Town Gardens and Town Docks” in order to authorize the Commissioner of the Department of Parks and Recreation to establish rules, subject to Town Board approval, regulating the presence of dogs in Town parks, Town gardens and Town docks. Such rules will establish on a trial basis the presence of dogs in certain areas of North Hempstead Beach Park, Mary Jane Davies Green, and Michael J. Tully Park.
